About these terms and conditions
These terms and conditions apply to your use of the Circu5 website and orders you place through it. They cover:
- products Circu5 fulfils directly, such as CDs and prints
- digital downloads
- merchandise sold through the Circu5 shop (such as t-shirts, hoodies, hats and mugs), which are fulfilled for us by our print-on-demand fulfilment partner, Printful.
By using this website or ordering through it, you agree to these terms and conditions.

Website use and intellectual property
Unless otherwise stated, all content on this website – including text, images, artwork, logos, audio, video, graphics and design – is owned by Circu5, Steve Tilling, or is used under licence. This section applies to the whole website, whether or not you place an order.
You may not copy, reproduce, distribute, adapt, publish or use any content from this website without prior written permission.
The CIRCU5 concept – including its characters, storyline, themes and fictional universe – is the original creative work of Steve Tilling. This includes the CIRCU5 organisation, Grady, and other related characters, settings and elements. All rights reserved.
No part of the CIRCU5 concept or any related materials may be copied, adapted, reproduced, published, distributed or used without Steve Tilling’s prior written permission.
Requests for permission relating to the CIRCU5 concept or related materials should be sent via this website's contact page.

Orders and payment
You can order products through this website. All orders are subject to acceptance.
Prices are shown in GBP (British pound sterling) unless otherwise stated. The website's checkout page will show you shipping charges and any applicable taxes before you pay.
We accept payment through the methods shown at checkout. We take payment when you order.
We will send you an order confirmation email after you order.

Product types and fulfilment
Circu5 fulfils some products directly, such as CDs and prints.
Merchandise items in our shop (such as t-shirts, hoodies, hats and mugs) are made to order and fulfilled for us by Printful. Printful uses fulfilment facilities in different regions, and usually fulfils orders within two to five business days before shipping. Delivery times vary depending on the destination.
We supply digital downloads electronically.

Delivery
We ship physical products worldwide. We aim to dispatch products that we fulfil directly within two to five business days, unless stated otherwise. Delivery times are estimates and may vary depending on the destination, customs processing and carrier delays.
Estimated fulfilment and shipping times for products from Printful may vary by product and destination. Printful may ship merchandise from different fulfilment locations.
If your delivery address is outside the UK, your order may be subject to import duties, VAT or other local charges. The destination country sets these charges, and are your responsibility.
Unless you arrange your own carrier, physical goods remain our responsibility until they are delivered into your physical possession, or into the possession of a person you identify to receive them.

Cancellation rights for physical goods
If you are buying as a consumer and your order is for physical goods bought online, you normally have the right to cancel your order within 14 days after receiving the goods. You then normally have a further 14 days to return them after telling us you want to cancel. To do this, please contact us stating clearly that you want to cancel your order.
Unless the item is faulty, incorrect or damaged, or we state otherwise, you are responsible for the return postage cost for cancelled physical goods.
The cancellation right does not apply in every case. For example, it may not apply to clearly personalised items or sealed CDs if they have been unsealed after delivery.

Faulty, damaged, incorrect or missing items
If a physical item arrives faulty, damaged, incorrect, or not as described, please contact us as soon as possible with your order number and, where helpful, photographs. Depending on the circumstances, you may be entitled to a refund, repair, replacement or reduced price under consumer law. Nothing in these terms affects your statutory rights.
If a merchandise item fulfilled by Printful arrives damaged, mislabelled or incorrect, or appears to be lost in transit, please contact us within 30 days where possible. Printful asks us to raise such claims within 30 days of delivery, or within 30 days of the estimated delivery date for lost shipments. This does not reduce any rights you may have under consumer law.
If shipping tracking shows a merchandise parcel as delivered but you have not received it, we may ask you to check with neighbours or your local delivery office first. Printful generally does not provide free reshipment where tracking shows the parcel as delivered.

Digital downloads
We supply digital downloads electronically. After payment, a download link is made available on the confirmation page and emailed to you.
If you are buying as a consumer, you have the right to cancel a digital download order within 14 days after the day of purchase. To cancel, please contact us stating clearly that you want to cancel. If you cancel within that period, we will refund the price you paid for the download.
This does not affect your statutory rights if a digital download is faulty, not as described or not fit for purpose.

Exchanges
We do not offer direct exchanges as a standard service. If you want a garment of a different size or colour, please contact us. Where you have a legal right to cancel a physical goods order, you may be able to return the item and order again.
This does not affect your rights if an item is faulty, damaged, incorrect or not as described.

Limitation of liability
Nothing in these terms excludes or limits any liability that cannot legally be excluded, or any rights you have under consumer law.
Subject to that, we are not liable for losses that were not reasonably foreseeable, or indirect or consequential loss arising from you using the website or buying products from it.
